Converging Fractal provides strategic advisory, consulting, coaching, and professional services related to global technical organization transformation, leadership development, and innovation enablement ("Services"). Information provided through the Site is for general informational purposes only and does not constitute professional advice.
5.2 No Professional Relationship
Merely accessing the Site or downloading materials does not create a professional services relationship between you and Converging Fractal. A formal professional relationship is established only through a separate written agreement signed by both parties.
5.3 No Guarantees
While we strive to provide high-quality services and accurate information, we make no guarantees or warranties regarding:

All professional services engagements are governed by separate written agreements between Converging Fractal and the client. In the event of any conflict between these Terms and a separate written agreement, the separate written agreement shall control.

You consent to the exclusive jurisdiction and venue of such courts.
11.3 Informal Resolution

We will attempt to resolve the dispute through informal negotiation within 60 days of receiving notice.
11.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
12. TERMINATION
12.1 Termination by You
You may stop using the Site at any time. If you have created an account, you may request deletion of your account by contacting us at contact@convergingfractal.com.
12.2 Termination by Us
We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
12.3 Effect of Termination
Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
13. GENERAL PROVISIONS
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any separate written agreements for professional services, constitute the entire agreement between you and Converging Fractal regarding your use of the Site.
13.2 Waiver and Severability
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect.

13.4 No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you and Converging Fractal.

13.6 Force Majeure
We will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, labor disputes, natural disasters, war, terrorism, governmental actions, internet service failures, or equipment failures.
13.7 Headings
The headings in these Terms are for convenience only and have no legal or contractual effect.

15. ACCEPTANCE
